PROTECTION POLICY OF PERSONAL CHARACTER DATA
JOLLYFIESTA, S.L.U. (the “Empresa”) is an Organization in which personal data treatment activities are carried out, which attributes to it an important responsibility in the design and organization of procedures so that they are aligned with legal compliance in this area.
In the exercise of these responsibilities and in order to establish the general principles governing the processing of personal data in the Company, approve this Personal Data Protection Policy, which notifies its Employees and makes available to all its Interest Groups.
1. FINALITY
The Personal Data Protection Policy is a proactive responsibility measure that aims to ensure compliance with and relationship with applicable legislation, respect for the right to honour and privacy in the processing of personal data of all persons related to The Company.
In development of the provisions of this Personal Data Protection Policy, the Principles governing the processing of data in the organization and, consequently, the procedures, and the organizational and security measures that people affected by this Policy undertake to implement in their area of responsibility.
To this end, JOLLYFIESTA, S.L.U. with address at C/ Martí Blassi, 81 Local 2, 08905 L'HOSPITALET DE LLOBREGAT (BARCELONA) and e-mail info@jollyfiesta.es, together with the Directorate will assign the responsibilities to the staff involved in data processing operations.
2. APPLICATION AMBITO
This Personal Data Protection Policy will be applicable to the Company, its administrators, managers and employees, as well as to all those who relate to it, with express inclusion of service providers with access to data (“Protection Officers”)
3. PRINCIPLES OF THE WORK OF PERSONAL CHARACTER DATA
As a general principle, the Company will scrupulously comply with the legislation on the protection of personal data and must be able to prove it (the principle of "proactive responsibility"), paying special attention to those treatments that may pose a greater risk to the rights of those affected (the principle of "risk approach").
In relation to the above JOLLYFIESTA, S.L.U. will ensure compliance with the following Principles:
- Licitude, loyalty, transparency and limitation of purpose. Data processing should always be reported to the affected person, through clauses and other procedures; and it will only be considered legitimate if there is consent to the processing of data (with special attention to the one provided by minors), or has another valid legitimization and the purpose of the data is in accordance with Regulations.
- Minimization of data. The treated data should be appropriate, relevant and limited to what is required in relation to the purposes of treatment.
- Exactly. The data should be accurate and, if necessary, updated. In this regard, the necessary measures will be taken to remove or rectify without delay any personal data that is inaccurate with respect to the purposes of the treatment.
- Limitation of the conservation period. Data will be maintained in a manner that allows the identification of stakeholders for no longer than necessary for the purposes of treatment.
- Integrity and Confidentiality. Data will be treated in such a way as to ensure adequate security of personal data, including protection against unauthorized or unlawful treatment and against their loss, destruction or accidental damage, through the application of appropriate technical or organizational measures.
- Data assignments. It is prohibited to purchase or obtain personal data from illegitimate sources or in cases where such data has been collected or transferred in contravention of the law or its legitimate origin is not sufficiently guaranteed.
- Recruiting providers with access to data. Providers will only be chosen for recruitment to provide sufficient guarantees to implement appropriate technical and security measures in data processing. These third parties will document the due Agreement in this regard.
- International data transfers. Any processing of personal data subject to European Union regulations involving data transfer outside the European Economic Area shall be carried out in strict compliance with the requirements set out in the applicable law.
- Rights of those affected. The Company will facilitate the exercise of the rights of access, rectification, deletion, limitation of treatment, opposition and portability by establishing to this effect the internal procedures, and in particular the models for their exercise that are necessary and timely, which must meet, at least, the legal requirements applicable in each case.
The Company will promote that the principles contained in this Personal Data Protection Policy be taken into account (i) in the design and implementation of all work procedures, (ii) in the products and services offered (iii) in all contracts and obligations that form or assume and (iv) in the implementation of all systems and platforms allow the access of employees or third parties and/or the collection or processing of personal data.
4. COMPROMISE OF WORKERS
The workers are informed of this Policy and are aware that personal information is an asset of the Company, and in this regard they adhere to it, committing themselves to the following:
- Conduct awareness-raising training in Data Protection that the Company makes available.
- Apply security measures at the user level that apply to your job, without prejudice to the responsibilities in your design and implementation that can be attributed to you according to your role within JOLLYFIESTA, S.L.U.
- Use the formats established for the exercise of rights by those affected and inform the Company immediately so that the answer can be made effective.
- To inform the Company, as soon as you have knowledge, of the deviations of what is established in this Policy, in particular of “Personal Data Safety Sites”, using the format established for this purpose.
5. CONTROL AND EVALUATION
An annual verification, evaluation and valuation will be carried out, or whenever there are significant changes in data treatments, the effectiveness of technical and organizational measures to ensure the safety of treatment.

Due to the entry into force of the reference modification of the “Information Society Services Act” (LSSICE) established by Royal Decree 13/2012, it is obligatory to obtain the express consent of the user of all the websites that use unsuccessful cookies, before it ships for them.

ac_cookies:Technical cookie and strictly necessary that contains the value of whether the installation of cookies has been accepted. It expires in 1 year since the last update.
_ga:Google Analytics cookie that enables the control function of unique visits. The first time a user enters the website through a browser will install this cookie. When this user returns to the web with the same browser, the cookie will consider it the same user. Only in the event that the user changes from browser will another user be considered. It expires at 2 years since the last update.
_gat:This cookie is associated with Google Analytics Universal. It is used to limit the speed of request - the limitation of data collection on high traffic sites. It expires at 10 minutes.

smclient: contact monitoring cookie.
smform: cookie for contact forms (pop up, landing page, iframe).
smg: cookie to identify the user, UUID identification.
smvr: cookie to identify visits, encoded in base64.
smwp: cookie for webpushes.
smg: cookie for global customer identification.
smcrsaved: cookie to know if the identifier has been saved in the system.
smOViewsPopCap: information cookie on pop up capping.
