The contracting procedure can only be carried out in the Spanish language.

6. AVAILABILITY OF PRODUCTS

The complete management of your order is subject to the availability of the requested products so that if at the time of preparing your order in our warehouse we do not have the product you want because there is no stock of it or because we consider that the product is not in conditions for your sale, we will inform you of this and you will be offered the shipment of another item or in reimbursement of the amount that you would have paid for it within a maximum period of seven days from when we inform you that the product cannot be delivered to you .

In any case, we will notify you of any modification that may occur in your order due to the non-availability of items.

7. SHIPMENTS

During the purchase process, the WEB will show the shipping options available and their price, for the shipping address indicated in the registration form or in the address form.



Conditions:

* Orders placed before 1:00 p.m. will be prepared and shipped the same day, as long as it is a business day. Orders placed after 1:00 p.m. will be prepared and shipped the next business day.

* Free shipping costs exclusively when shown in the shipping options with price 0.

* Collection service in stores: you can request free collection of the order in one of our stores for orders over €40 in the Peninsula. Shipping costs are free and the delivery time will be the same as for orders delivered to a home.

* Orders placed on weekends and holidays (national and/or local) are prepared the next business day.

* You will receive an email notification where you can track the delivery of your order on the carrier's website.



Conditions:

Additional conditions:

Balloon duration: Helium balloons last inflated about 3-4 days in good condition.

Guarantee: Once the bouquet has been delivered, in good condition, the customer is responsible for taking the necessary precautions so that the bouquet lasts in good condition for as long as possible (keep it away from light sources, fire, drafts , radiators, heating,...).

If you receive broken or damaged balloons, you must contact us within 4 hours of receiving the order through the different communication channels available, or send us an email to: info@jollyfiesta.es attaching photos, both of the product or/and bouquet and of the box where the incident can be seen.


The client will agree to send another product or/and bouquet for another day or the refund of the amount paid.

If you do not notify us of the incident within this period of time, no claim will be accepted since the balloons remain in good condition for a period of days.


Returns: Returns of inflated bouquets or individual balloons, costumes, make-up or costume accessories, custom-made or personalized products for a specific client, gifts, accessories or accessories for social events such as weddings, baptisms and communions, but not excluding other social events, are not accepted. Cancellations once the order has already been processed. As indicated in section 10. RETURN AND REFUND POLICY in the General Purchase Conditions, and as established in article 103 of Law 3/2014, of the General Law for the Defense of Consumers and Users, personalized items, which may deteriorate or expire quickly
, are exempt from withdrawal. As the balloon bouquets are inflated, therefore perishable, no return of this product will be made.

8. NON-DELIVERY

Before receiving your order, you will receive an email notification informing you of the shipping status.
In the event that you had chosen delivery to one of our physical stores as the delivery method, when the order has been received and validated by our employees you will receive a call or an email informing you that you can now pick it up at the store chosen. The period available to pick up your order is 21 days from when you receive confirmation that your order is pending collection at the store you have chosen. If after this period you do not go to the store to pick it up, we will understand that you wish to withdraw from the order. Contract and we will consider it solved.


In the event that you have chosen home delivery, if 14 days after your order is available for delivery, you do not pick it up, we will understand that you wish to withdraw from the Contract and we will consider it resolved.


As a result of the termination of the Contract, we will proceed to refund the full amount of the purchase including shipping costs, if paid, on the same card with which you made the online purchase, unless you choose a different means of payment.


If you made the payment for your order through your PayPal account and we cannot serve it, we will deposit the amount of the same in your PayPal account.

 

9. RATES AND PAYMENT CONDITIONS

The price of the products will be the one stipulated at any time on our website. Obviously, the price and other conditions of the items that you have requested will not be modified during the period of time between your offer and the acceptance of the same issued through the shipping confirmation unless by law or decision of government agencies we must make changes retroactively in said policies, Conditions or Privacy Statement, in which case, the possible changes will also affect the orders that you had previously made.

10. RETURN AND REFUND POLICY

The customer must return the items that he does not want, together with the invoice or purchase confirmation, within a period of 14 business days from the date of receipt of the merchandise, to the following address:

JOLLYFIESTA, SLU recommends that the item be returned in its original packaging, otherwise the item may not be fully refunded. The costumes can only be opened to verify the size or the condition of the costume (non-conforming).

JOLLYFIESTA, SLU only accepts the return of items that meet the following characteristics:

Preferably the package must be in the same box or protective packaging and with its original label. If this is not possible, the shipment must be made in similar packaging conditions so that it arrives in good condition at the JOLLYFIESTA, SLU warehouse. The product must not be used or modified. This means that it will not be worn, washed and all accessories must be included. Please check the parts included in the package before returning the product.

The return of the following products is not allowed:

* Custom Products


* Sealed products, airtight packaging such as gloves, stockings, pantyhose, etc., cannot be refunded once opened.

Each item returned in accordance with the general return conditions will be refunded within 14 business days from the date of request for a refund.

This period will be extended until receipt of the merchandise at the JOLLYFIESTA, SLU warehouse , or until the client sends us proof of shipment of the product.

Returns will only affect the value of the merchandise, not refunding the corresponding shipping costs, neither the initial nor the return, except in the case in which a product has been sent wrong or defective by JOLLYFIESTA, SLU, in this case the return costs are borne by JOLLYFIESTA, SLU


Defective products:

In the event that you have received a defective product, and depending on the situation, the replacement, price reduction, management and procedures will be carried out by JOLLYFIESTA, SLU

Refund:

Each returned item will be refunded within 14 days from the date of the return request.

This period will be extended until the merchandise is received at the JOLLYFIESTA, SLU warehouse or until the client sends us proof of shipment of the product.

If you have paid for the order by bank transfer, you must send us your bank details to proceed with the corresponding refund.

 

11. LIABILITY AND GUARANTEES IN OUR PRODUCTS

The legal guarantee of all our products is the one defined by law, and its terms will always be respected by JOLLYFIESTA, SLU

The aforementioned guarantee is regulated by the Consolidated Text of the General Law for the Defense of Consumers and Users, which establishes that the minimum guarantee period for any new article will be 3 years, although after the first six months , it is the client who must prove that the problem presented by the article is a defect of origin and not a wear produced by the habitual and correct use of the product.
